46.2.  Service Provider not Responsible

The Service Provider shall not be responsible for or obliged to indemnify the Authority for:-

46.2.1.  any matter referred to in clauses 46.1.1 to 46.1.4 above which arises as a direct result of the Service Provider acting on the instruction of the Authority;

46.2.2.  any injury, loss, damage, cost and expense caused by the negligence or wilful misconduct of the Authority or any Authority Related Party or by the breach by the Authority of its obligations under this Agreement; or

46.2.3.  any claims made pursuant to clause 46.1.2 in respect of Authority Property or clause 46.1.4 in excess of [  ].
