59.  EXERCISE OF STATUTORY AUTHORITY

Nothing in this Agreement shall be construed as a fetter or restriction on the exercise of the Authority's [planning or highways]53 function nor, without prejudice to the Service Provider's rights and remedies under this Agreement, on the exercise of any other statutory function by or on behalf of the Authority.
