14  Housing Benefit Failure

Provisions relating to Housing Benefit Failure are not relevant for non-HRA Projects and should be deleted.  Accordingly, clause 28.3.3 of HPP is to be deleted along with the definition of Housing Benefit Failure Event.  The inclusion of such an event as an Excusing Event is also not relevant for a non-HRA Project.  Collection of Rents and Service Charges (however paid) is a risk to be wholly assumed by the Contractor or Housing Management Contractor as landlord of tenants.
