25  General Definitions (HPP Ref: Clause 1.1 (Definitions))

Apartment Block means a building comprising of one or more Dwellings and any Common Parts and the expression Apartment Blocks shall be construed accordingly;

Change in Revenue means, in respect of any Relevant Event, the effect of that Relevant Event (whether of a one-off or recurring nature, and whether positive or negative) upon the actual or anticipated income of the Contractor and/or any Sub-Contractor [and/or the Landlord]8 (without double counting);

Common Parts means any:

(a)  sewers, drains, channels, ducts, watercourses, cables, pipes, wires and heating systems or other services installations;

(b)  accesses, entrances (including door entry systems), lifts, reception areas9, passages, corridors, landings, staircases, gardens, refuse areas, forecourts, roadways, car parking and pathways; and

(c)  roofs, walls, floors, ceilings, foundations, timbers, joists, beams, chimney stacks, gutters and rain water and soil pipes,

used in common by Tenants and/or Occupiers of an Apartment Block save to the extent that they are adopted by a public or statutory authority or utility and maintained at public expense;

Disclosed Title Matters means for each Site [the official copies and plan (where land is registered) epitome of title (where land is unregistered) and copies of any title documents for that Site10;

Dwellings means a house, flat or bungalow (together with all supporting infrastructure and any associated curtilage) designed and construed by the Contractor for rent by a Tenant under a Tenancy Agreement and the expression Dwelling shall be construed accordingly;

Landlord means the landlord of a Tenant11 and shall include the tenant from time to time under the Leases;

Occupier means any member of a Tenant's household or other lawful occupier of the relevant Dwelling;

Phase means a phase of the Works comprising the Dwellings and any Common Parts identified in column 1 of the table set out at [Schedule ] (Phases and Planned Services Commencement Dates);

Replies to Enquiries means for each Site the [Replies to Standard Pre-contract Enquiries (General) (CPSE.1v2.6)/Replies to Standard Pre-contract Enquiries (Supplemental) Property subject to tenancies (Commercial) (CPSE.1v2.2)] prepared by the Authority and provided to the Contractor12;

Site means the area edged red on the relevant Site Plan (shown for identification purposes only) together with the Dwellings, Common Parts and the service ducts and media for all utilities and services comprising the Dwellings and Common Parts [and the expression Sites shall be construed accordingly];

Site Plan means the plan of [the/each] Site set out in Schedule [] (Site Plans) and the expression Site Plans shall be construed accordingly;

Tenancy Agreement means a tenancy agreement governing the occupation by a Tenant of a Dwelling in the form set out in [Appendix ], as amended from time to time in accordance with clause 28.3(d) (Tenancy Agreement);

Tenant means the person who from time to time is a tenant of a Dwelling under a Tenancy Agreement;

In the definition of Contractor Related Party the words "any Leaseholder and" should normally be deleted.
