38  Surveys on Termination and Retention Fund (HPP Ref: Clause 41)

Clause 41.1 (Final Survey) to be replaced with the following:

Where the Authority has served an Expiry Option Notice on the Contractor then [nine (9)] months prior to the Expiry Date, the Authority shall be entitled to carry out a final survey of the [Dwellings/Common Parts/Apartment Blocks] to assess whether they have been and are being maintained by the Contractor in accordance with its obligations under clause 22.1 (Maintenance).

Note that in clause 41.5 the period of time should be changed to six (6) months.
