46  Service Charges

The following is suitable drafting for Service Charges and represents new provisions to be inserted into HPP:

Agreed Service Charge means the Service Charge as set out in the Base Case at the Commencement Date as adjusted from time to time provided (and irrespective of whether or not the Landlord is a [Registered Social Landlord]) that such Service Charge is set in accordance with and does not contravene any relevant guidance or Legislation that is applicable to a [Registered Social Landlord] and which relates to the setting, calculating and charging of service charges;

Service Charge means the service charge to be charged by the Landlord to a Tenant under a Tenancy Agreement in accordance with clause 1 (Service Charges) and the expression Service Charges shall be construed accordingly;

Service Charge Services means any services provided or procured by the Landlord for the Common Parts for which the Landlord is entitled to recover a service charge under a Tenancy Agreement;
