1  DEFINITIONS1

"Available"

the Property/Zone meets the standards set out in section 7 of this Output Specification at either the Interim Standard prior to Certification or the Full Standard after Certification.

"Availability", "Unavailable" and "Unavailability" shall be construed accordingly.

"Certification"

the process by which the Property/Zone is validated to meet the Authority's requirements as set out in section 6 of this Output Specification.

"Competent Person Scheme"

A scheme set up under the Building Regulations 2000 (SI 2531/2000) as amended by the Building (Amendment) Regulations 2001 (SI 3335/2001) and the Building (Amendment) Regulations 2002 (SI 440/2002) using powers in Schedule 1, para 4(a) of the Building Act 1984 that allow a contractor to self-certify that works carried out meet the requirements of the Building Regulations without recourse to the local authority building control department.

"Core Service Hours"

Monday to Friday [ ]am to [ ]pm excluding Bank Holidays2

"Minimum Tolerable Level"

The level of performance at which the Contractor receives maximum Service Failure Points for an individual service, as set out in section 8 of this Output Specification

"Performance Standards"

The standards to which the Contractor must perform as set out in section 8 of this Output Specification.

"Standard Service Level"

The level of performance required by the Authority for the Contractor to avoid accruing Service Failure Points, as set out in section 8 of this Output Specification

"Tenancy and Estate Management Services"

"TEMS"

The services required by the Authority as set out in section 8 of this Output Specification

1 It is assumed that terms not specific to the Output Specification ("Contractor", "Authority", "Dwelling", etc.) will be defined in the Project Agreement.  The Authority should ensure that this is the case and generally ensure that definitions in all of the contract documentation are complimentary to each other.

2 Some authorities have developed this definition further, either by including extended hours on one weekday, or having a Saturday opening.  Any such inclusions need to be carefully considered on value for money grounds and with regard to the hours the service being replaced is operating..
