Unavailable But Used

3.10.  If any Dwelling is Unavailable after the relevant Rectification Period has expired but is nevertheless still occupied by the Tenant or Leaseholder, then the Dwelling will be deemed to be Unavailable But Used.

3.11.  When a Dwelling is Unavailable But Used, the Unavailability Deduction, which the Authority shall be able to make will be reduced by 25%, subject to any Repeated Unavailability Ratchet that may apply.
