2  Services and works

2.1  You shall provide the services listed in and the works described in the documents contained in Appendix 2, which documents shall, in this Appointment, be referred to as the "Contract Documents" together with such other services and works as may be necessary for or ancillary to the proper completion of such services and works listed and/or described in the Contract Documents ("the Services").

2.2  Subject to Clause 11, you must comply with all reasonable instructions given by the Council or on our behalf by the Employer's Representative (referred to in Clause 11) in writing under or in connection with this Appointment.

2.3  You shall observe and comply with the duties, obligations and requirements on your part to be observed and complied with contained within the Contract Documents, provided that in the event of any inconsistency or ambiguity between the provisions of this Appointment and the Contract Documents, this Appointment shall prevail.

2.4  Subject to Clause 7.3, you shall provide such other services and works as the Council may reasonably require in writing.

2.5  You shall be entitled to rely on information obtained from statutory undertakers as to the existence and location of services within the Properties save to the extent that a surveyor with experience of carrying out similar services would have realised that such information was incorrect and (save as aforesaid) you will not incur any liability in that behalf in the event that such information proves to be incorrect.

2.6  In addition you shall not incur any liability in respect of failure to carry out any part of the Stock Condition Survey to the extent that access to the relevant part of the Properties is not available or shall otherwise be denied to you provided that you have given the Council sufficient notification of your inability to gain access and have given the Council a reasonable time to ensure access is available (including access to suitable alternative parts of the Properties) and if (notwithstanding the foregoing) the relevant denial of access is listed in the final reports and database produced by you in respect of the Properties and your report is qualified accordingly with your view on the effect on the accuracy of your report.
