5  Project Surveyor

5.1  You agree that [                         ] shall be appointed to be Project Surveyor for the Stock Condition Survey, with responsibility for the overall management, supervision and co‑ordination of your obligations hereunder.  The Project Surveyor shall not be replaced save with the consent of the Council or save for unavoidable necessity or pursuant to Clause 5.2 below, and any replacement shall be subject to the prior approval of the Council.

5.2  If the Council receives a complaint about the conduct of any employee, agent, or contractor, including for the avoidance of doubt the Project Surveyor, engaged by yourselves to undertake the Services from a member of the public the Council may instruct you in writing to ensure that that employee, agent or contractor concerned has no further contact with the public as part of its role in the delivery of the Services.  You shall comply with any such request with immediate effect.  If the employee, agent or contractor concerned is the Project Surveyor then you shall replace the Project Surveyor in accordance with Clause 5.1 above.
