4.  Copyright

4.1  The Surveyor grants to the Beneficiary an irrevocable, non-exclusive royalty-free licence to use and reproduce any of the drawings, details, plans, specifications, calculations and other information (whether paper, computerised or otherwise) which have been or are prepared by the Surveyor for the purposes of the Appointment and the methodology and designs contained in them ("the Documents") for the undertaking of the Appointment, and to grant sub-licences in the terms of this licence, but the copyright therein shall remain vested in the Surveyor.  Subject to Clause 4.2, the Surveyor shall not be liable for any use by the Beneficiary of the Documents for any purposes other than those for which the same are or were prepared.  The Beneficiary shall on written request and upon paying a reasonable copying charge, be entitled to be supplied by the Surveyor with copies of the Documents.

4.2  If the use or reproduction of the Documents for the purposes of the Project is found to infringe the rights of any third person, the Surveyor shall indemnify the Beneficiary against all resulting costs, damages and expense.
