5.  BINDING OF SECOND EMPLOYER TO SURVEYOR

The Second Employer binds itself to the Surveyor in the terms of the Appointment as if the Second Employer were and always had been named in the Appointment in place of the Council but without any liability for any act or omission on the part of the Council (including any wrongful acts or omissions).
