1.  DUTY OF CARE [AND OTHER OBLIGATIONS]

1.1  The Surveyor warrants and undertakes to the Beneficiary that he has:

(a)  exercised and will continue to exercise in the carrying out of the Services required under and as defined in the Appointment all the reasonable skill and care and diligence to be expected of professionally qualified and experienced surveyors performing services like those undertaken by the Surveyor under the Appointment in relation to projects of the scale and character of the Project; and

(b)  carried out and will continue to carry out its other obligations and duties under the Appointment in accordance with the Appointment.
