5.  EXTRANEOUS RIGHTS

5.1  This Deed shall not negate or diminish any duty or liability otherwise owed by the Surveyor to the Beneficiary.

5.2  No approval or inspection of the Project or of any documents and no testing by or on behalf of the Beneficiary and no omission to inspect or test shall negate or diminish any duty or liability of the Surveyor arising under this Deed.
