3  29Scalability

3.1  The Network shall where available support tail circuits and port speeds ranging from [XX kbit/s] to [XX Mbit/s].

3.2  Local access - flexible Bandwidth

(a)  The Supplier shall, at the Authority's request, provide port speeds that are lower than the capacity of the tail circuits.

(b)  The Authority shall have the ability to change the port speed within the capacity of the tail circuits up to the allowable capacity in respect of those tail circuits as set out in the table below.

29  What are the Service Providers obligations in relation to the ability to increase or decrease the capacity provided to the Authority? This is an important issue as the Authority does not want to be limited should its needs for bandwidth increase over the life of the Agreement.
