Contractual Structures

The Local Authority intends to follow the guidance and Model Contract included in the CATSS Procurement Pack produced by 4ps.   Please confirm that you accept the principles set out in that guidance and the provisions of the Model Contract.

If you do not accept the principles in the Guidance or any provisions of the Model Contract please provide a table (setting out comments as appropriate) explaining how and why your proposed approach differs from the Guidance and Contract.  

N.B. Bidders should note that the Authority reserves the right to take failure to accept the Guidance and provisions of the Model Contract into account in evaluating its submissions.

Please also provide preliminary comments on the following contractual matters:

•  Contract term  and approach to residual life of assets

•  Risk allocation in the Project - as set out in the Model Contract

•  Proposals for monitoring service delivery

•  Proposals for the inclusion of Further Services

•  Termination events and consequences of early termination

•  Treatment of IPR created during the contract term

•  The change mechanisms, covering all aspects of change i.e. programme growth, change in the service specification and legislative change.
