4. Tailoring the contract to project-specific needs
In addition to the broad structural principles of the target application, set out above, the baseline form of MISMA is founded on a specific commercial model, which in turn is based on a number of key assumptions, which are listed inn Table 2, below.
Having understood the target application, Authorities intending to use MISMA should therefore follow the steps below to determine whether their application warrants revisions to the baseline MISMA form.
1. Review Table 2 in Section 4.1 to identify where the application under consideration varies materially from the baseline case (Step 1).
2. Refer to the relevant part of section 5 to understand the issues and the nature and scope of the possible consequential changes to the baseline drafting (Step 2).
3. Consider the risk allocation and value for money implications of any change to the baseline drafting (Step 3).
4. Implement any changes to the baseline drafting that are justifiable both commercially and in terms of overall value for money (Step 4)
