69.  THIRD PARTY RIGHTS

69.1  Subject to Clause 43.8 (Confidentiality), and Schedule D.5 (Staff Transfer), a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.

69.2  Any rights created under Clause 69.1 may be altered or extinguished by the parties without the consent of the third party beneficiaries.
