50. Where there is doubt over the ability of the bidders to achieve a competitive rate for funding the PFI project, the project may wish to consider running a funding competition. If it is likely that this option will be exercised, the provision should be stated in the OJEU notice. This will only be appropriate in some cases and thought must be given to the trade off between the transaction costs associated with this versus the potential gains.
51. Changes in the scope or requirement of the project or the project team's requirements following the selection of the preferred bidder should be avoided wherever possible as at this stage competition is absent. Similarly, project teams should be clear about their own responsibilities under the contract and document the internal resource used for the procurement process.
