The Company shall pay liquidated damages equivalent to [●] for each hour or portion thereof in excess of the maximum number of Planned Downtime allowed that is not an Unplanned Downtime. The Performance Security will be used to guarantee the payment of such penalty. In the event the Company exceeds the allowable Planned Downtime indicated in Section 6.5 by more than [●] percent, such occurrence will either constitute a Company Event of Default or will result in the imposition of a penalty double the amount herein specified, at the option of the Agency.
