- The proceeds from insurance claims, except Third Party Liability Insurance and Workmen's Compensation Insurance, with respect to loss or other damage to the PROJECT, shall first be applied by the PROPONENT-OPERATOR to the extent necessary to fully repair or restore the PROJECT to its previous operating condition, or to completely rebuild the PROJECT.
