Contract variation:

With regard to child care provision, the Concession Deed stipulated (as part of a third-party user agreement) that these services would be run independently of the schools and by Axiom Education's service provider (New South Wales Treasury 2005a: p.1; New South Wales Treasury 2005b: p.44), including the delivery of out of school hours care on the school grounds and / or within the child care centre grounds (New South Wales Treasury 2005a: p.47). Typically, this type of service in New South Wales is provided by not-for-profit organisations (under the oversight of school principals) but exceptions were made due to the nature of the PFP agreement (New South Wales Treasury 2005a: p.47).

Soon after operations commenced, a number of parents raised concerns with the Department of Education over the quality of the contractor's services (New South Wales Treasury 2005a: p.47). After investing the complaints, the Department took steps to terminate the provision of out of school hours care services (triggering a variation to the contract). This situation led to individual schools taking ownership of providing out of school hours care to their local 'school community' (New South Wales Treasury 2005a: p.47).
