Enforcement decisions taken by decision-makers should be consistent with relevant contractual clauses (i.e. penalty clauses) and be consistently applied to instances of under-performance, unless there is a properly justified case for not doing so (see below). Continued under-performance should result in the use of cure plans and production of default scenarios, as appropriate.
