If a Force Majeure Event occurs:
(a) (suspension of obligations): the obligations of each party under this Deed which are prevented by the Force Majeure Event will be suspended to the extent of such prevention; and
(b) (no breach or default): the failure to perform such suspended obligations will not be a breach of this Deed by Project Co or the State, a Project Co Act or Omission or an act or omission of the State, a Major Default or a Default Termination Event.
