26.16  Acceleration Notice

If:

(a)  (delay by an Extension Event): any part or the whole of the Development Activities are delayed by an Extension Event; and

(b)  (entitlement to extension of time): Project Co is or would have been entitled to an extension of time to a Date for Acceptance for that Extension Event under this clause 26,

whether or not the Independent Reviewer has made a determination in accordance with clause 26.9, the State may direct Project Co to submit a claim (by way of Change Notice) to the State and the Independent Reviewer setting out the estimated time and cost consequences of accelerating any part or the whole of the Development Activities to overcome or minimise the extent and effect of some or all of the delay including, if required, in order to achieve Acceptance by the relevant Date for Acceptance, and Project Co must submit a Change Notice to the State and the Independent Reviewer within 10 Business Days after the State's direction and the Change Compensation Principles will apply.
