5.4  Not put State in breach

In carrying out the Project Activities, Project Co must ensure that neither it nor any Project Co Associate causes the State or any State Associate to breach or fail to comply with:

(a)  any applicable Law or Standard; or

(b)  [the Commonwealth Funding Conditions]. [Note: Delete paragraph (b) if no Commonwealth funding is applicable to the Project.]
