(a) Subject to clause 35.7(b), where a Modification is a State Initiated Modification this will be a Change Compensation Event and, without limiting clause 35.8(g), Project Co or the State (by way of Savings) will be entitled to claim compensation as set out in Item 10 of Table 1 of the Change Compensation Principles which will be calculated and determined in accordance with the Change Compensation Principles.
(b) Where the Modification is:
(i) a Compensable Change in Mandatory Requirements which is a General Change in Law, Project Co or the State's entitlement to compensation will be in accordance with Item 14 of Table 1 of the Change Compensation Principles, which will be calculated and determined in accordance with the Change Compensation Principles; or
(ii) for the repair or reinstatement of loss or damage to the Project Assets, Project Co's or the State's entitlement to compensation will be limited in accordance with clause 42.4.
