Project Co acknowledges and agrees that the State is not obliged to exercise its rights under clause 38.2 and, if it exercises its rights under clause 38.2 is not obliged to Cure any breach, or to overcome or mitigate the event (or any of the consequences of the event) that gave rise to the exercise of the State's rights under clause 38.2.
