15.5  Unfettered discretion

The Proponent acknowledges and agrees that:

(a)  nothing in this deed will in any way unlawfully restrict or otherwise unlawfully affect the unfettered discretion of the State to exercise any of its functions and powers pursuant to any Law;

(b)  without limiting clause 15.5(a), anything which the State does, fails to do or purports to do pursuant to its functions and powers under any Law or otherwise will not be deemed to be an act or omission by the State under this deed; and

(c)  each reference to "the State" in this clause 15.5 will be taken to include a "Government Agency".
