10.5.  Addenda

The Respondent and each Respondent Member agrees that:

(a)  at any time during the Tender Process the State may, at its discretion, amend the Invitation for EOI (including the Terms and Conditions) or the RFP, by issuing an Addendum; 

(b)  none of the State or any of its Associates will have any liability to the Respondent or any Respondent Member as a consequence of any such Addendum; and

(c)  the Respondent must prepare its Proposal to take into account and reflect the content of any such Addendum.
