(a) The terms and conditions for the Tender Process are contained entirely in the Invitation for EOI and the RFP. There are no undertakings, agreements, warranties or representations (express or implied), with respect to the matters contemplated by the terms and conditions except for those referred to in them.
(b) The Respondent must notify the State in writing if the Respondent or a Respondent Member is of the opinion that there is any error or discrepancy in the Invitation for EOI or the RFP, as soon as reasonably practicable after discovering it.
(c) Following receipt of a written notice pursuant to Clause 17.4(b), or if the State otherwise discovers an ambiguity, discrepancy or inconsistency, the State in its sole and absolute discretion, will direct the Respondent in writing as to how to resolve the ambiguity, discrepancy or inconsistency.
