Guidance note: Where the Project has been assessed as requiring referral to the Australian Government Minister for the Environment to determine if the Project is a controlled action requiring assessment and approval under the Environment Protection and Biodiversity Conservation Act 1999 (Cth) (EPBC Act), details of the referral should be provided to Respondents including details of any determination as to whether a Project is a controlled action.  

If following a referral, a determination has been made prior to issue of the RFP that the Project is a controlled action and requires assessment and approval under the EPBC Act before it can proceed, the RFP should outline the status of the assessment and approval under the EPBC Act.
