3.3  Site Investigations and Information

Guidance note: This Section is intended to provide details of:

▪  any investigations, assessments and works that have been or will be undertaken by the State in relation to the Site(s);

▪  where applicable, the purpose of the Site investigations, assessments and works (e.g. to assess ground conditions in order to inform design and planning);

▪  information that has been collected and/or collated to date; and

▪  whether available reports, plans and other documents relating to Site investigations, assessments and works have been, or will be made available, to Respondents, and any conditions of release.

Example site investigation works from other Partnerships Victoria 'availability' PPP projects have included:

▪  Cultural Heritage Management Plans;

▪  flora, fauna and biodiversity conservation surveys;

▪  site level and feature surveys;

▪  contaminated land, remediation and geotechnical investigations; and

▪  hydrological investigations; and

▪  environmental audits.

This Section should also set out the State's proposed risk allocation in respect of geotechnical and contamination risk.  Where the State is seeking to transfer geotechnical and contamination risk to Project Co, details of any Site investigations undertaken, and reports obtained by, the State to support the risk transfer to Project Co should be provided.  Procuring Agencies should procure third party reliance in respect of any Site information reports to enable this risk transfer.

Each Respondent is responsible for carrying out any further investigations and surveys that may be required to understand Site conditions for the purposes of their particular solution.  Respondents should advise the State if they intend to undertake their own additional due diligence of relevant parts of the [#Site / #Sites] in accordance with the process described in the ITP Plan.
