Identification of the procurement strategy is important to achieve certain key objectives throughout the procurement process - chief among them is the undertaking of a smooth Tender process that combines the overriding principles of transparency, freedom of competition, and the fair treatment of Bidders. (Note: For detailed guidance on the Tender process, refer to Section 4 of this document). This is a crucial step to ensure the setting of an appropriate precedent procurement and establish credibility for future transactions. In order to implement an appropriate project strategy and roadmap for this purpose, it is advised that the following steps be taken:
Present an implementation strategy for the recommended delivery option, including the policy framework of the project, list of required approvals and key documents to be addressed during the procurement process, and proposed project management structure;
Create a project roadmap that includes target dates for completion, and the overall project plan; and,
Outline the key risks and challenges to the procurement Timeline, and suggest mitigation strategies to avoid future complications.
Identify if the success of a PPP Project is dependent on a required change to the regulation
Consider the country value addition on a case by case basis, depending on the type of project and the in-country resources available for the project
DoF is the custodian of the PPP Law and the PPP Framework. In the event a change is required, it will be evaluated, if the change can be implemented through the guidelines and if a more fundamental change is required then DoF will implement the changes in the PPP Law, and process the necessary approvals. SFC is the ultimate authority to provide exemption or other changes to the law.
In addition, the roles and responsibilities of the Government Entity need to be clearly identified and stated -videlicet:
• whether there will be any sovereign guarantees to be provided;
• whether the nature, Timeline, and quantum of payments to be provided;
• whether the provision of all other support, including, but not limited to, land; whether there will be any additional subsidies to be provided, and, if so, what the nature of them will be; and,
• whether there will be any shared services between the government and the Preferred Bidder once the project commences.
