GUIDANCE

There are three key aspects of Contract Management that need to be noted by the Government Entity:

Contract Management structure: the responsibilities, communication mechanisms, and protocols that will govern the relationship between the public and private sector will need to be outlined clearly prior to signing the agreement.

Change management: stating the procedure for dispute resolution, contract modifications, termination, and renegotiation.

Contract expiry: managing the procedure to be followed at the end of the concession term, such as whether the project will be re-Tendered or whether the relevant Assets will be transferred back to the government, and, if so, how that will be handled.

Contract Management begins at the initiation stage of the PPP Project Lifecycle in order to address all concerns related to the implementation of the Project until the end of the procurement stage, and is put into practice after the signing of the Partnership Contract for the development, delivery, and handover phases.
