11.14 I have received evidence from the CIEC (and others) about the liability of firms supplying goods and materials to main and specialist/trade contractors. In its final report, the CIEC suggests that the suppliers' ability to contract out of their liability by exclusion clauses should be restricted. (The National Council of Building Materials Producers (BMP), who are members of the CIEC, disassociated themselves from this recommendation.) There does appear to be a disparity between suppliers' liability and those of the others in the construction chain. However, this touches on wider issues relating to sale of goods legislation. I do not feel that there has been sufficient evidence or discussion of this specific problem for me to make any recommendation. However, it could be discussed further by the proposed Implementation Forum.
